Please read these Terms and Conditions carefully before subscribing to or using this service. By subscribing, you confirm your acceptance of all terms set out herein.

1. General

This document constitutes a legally binding agreement between you, the Subscriber, and NetEdux (Pty) Ltd, Company Registration: 2023/805462/07, governing your use of the Value Added Services delivered via the Vodacom Digital Services Platform.

These Terms and Conditions apply to all digital content, media and interactive services accessed through this platform.

NetEdux reserves the right, at its sole discretion, to amend, modify or update these Terms and Conditions at any time. Amendments will take effect immediately upon publication on the service platform or notification to the Subscriber via SMS or digital channel. Continued use of the service after such publication constitutes acceptance of the revised terms.

This service must not be used to engage in any unlawful conduct. NetEdux will not knowingly create, store or disseminate illegal content, nor will it infringe any copyright or intellectual property rights. The service must not be used to send unsolicited communications or spam.

2. Eligibility and Access

By subscribing to this service, you confirm that:

  • You are at least 18 years of age; or
  • You have obtained the express permission of the account or bill payer if you are under 18 years of age; and
  • You are an authorised Vodacom subscriber or pre-approved network subscriber with access to the Vodacom Digital Platform.

By accessing this service you accept, without limitation or qualification, all of the Terms and Conditions in this agreement.

3. Service Description

NetEdux provides subscribers with access to premium digital content delivered through the Vodacom Digital Services Platform. This includes, but is not limited to:

  • Educational videos and multimedia learning content
  • Interactive games and knowledge-based activities
  • Digital text resources, articles and reference materials
  • Images, graphics and creative content
  • Other Value Added Services as introduced from time to time

All content is accessible via web and WAP interfaces. WAP access may attract additional GPRS or data costs imposed by Vodacom or your network operator. Please contact Vodacom or your network operator for data pricing details.

4. Subscription and Billing

4.1 Subscription Fee

Subscribers are charged a fixed daily subscription fee of R7.00 per day for access to the service and associated digital content.

4.2 Billing

  • Charges are applied daily to the Subscriber's Vodacom account or prepaid balance.
  • Billing errors, where they arise, remain chargeable pending investigation and resolution.
  • Network operator fees and data costs may apply in addition to the subscription fee.
  • All services are provided on a non-transferable basis and carry no cash or monetary value.

4.3 Cancellation / Unsubscribe

Subscribers may cancel their subscription at any time using the applicable Vodacom VAS cancellation channel, including *135*997# where available.

Cancellation takes effect from the date of request. No pro-rata refunds are provided for partial billing periods already charged.

5. Intellectual Property

All materials made available through the service, including text, images, videos, graphics, illustrations, artwork, music, sound, names, logos and trademarks, are the property of NetEdux (Pty) Ltd or its licensed content partners. These materials are protected under South African copyright, trademark and applicable intellectual property laws.

Content accessed through this service is licensed for personal, non-commercial use only. You may not:

  • Reproduce, modify, retransmit, distribute or publish any content without prior written permission from NetEdux;
  • Use any content for commercial purposes; or
  • Remove or alter any copyright, trademark or proprietary notices.

6. Subscriber Obligations

As a Subscriber, you agree to:

  • Use the service strictly in accordance with these Terms and Conditions and applicable South African law;
  • Not use the service for any unlawful, fraudulent, abusive or harmful purpose;
  • Not attempt to gain unauthorised access to any system, server or network associated with the service;
  • Not upload, post or transmit any illegal, offensive or infringing content;
  • Safeguard your account credentials and not share them with third parties; and
  • Accept responsibility for all activities conducted through your account.

7. Privacy and Data Protection

7.1 Personal Information Collected

To provide this service, NetEdux collects and processes the following personal information:

  • Mobile number, used as subscriber identifier on the Vodacom Digital Platform;
  • Subscription status and service usage data; and
  • Device and network access information, where applicable.

7.2 Use of Personal Information

Your personal information will be used to:

  • Activate and manage your subscription;
  • Send service-related notifications via SMS;
  • Resolve billing queries and disputes;
  • Comply with regulatory obligations and WASPA requirements; and
  • Improve the quality and relevance of the service.

7.3 POPIA Compliance

In accordance with the Protection of Personal Information Act, No. 4 of 2013, NetEdux is committed to the lawful, fair and transparent processing of your personal data.

Your information will not be sold to third parties. NetEdux will only share information with Vodacom and WASPA to the extent necessary to manage the service, resolve complaints or meet regulatory requirements.

7.4 Opt-Out and Data Removal

Subscribers may remove their number from distribution lists and discontinue marketing communications through the applicable Vodacom opt-out or unsubscribe channel, including *135*997# where available.

8. WASPA Membership and Compliance

NetEdux (Pty) Ltd is a member of the Wireless Application Service Providers' Association and is bound by the WASPA Code of Conduct.

Subscribers have the right to approach WASPA to lodge a complaint in accordance with the WASPA Complaints Procedure. NetEdux may be required to share information relating to a service or a subscriber with WASPA for the purpose of resolving a complaint.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NetEdux (Pty) Ltd, its subsidiaries, affiliates, agents, representatives or licensors shall not be liable for:

  • Any loss, injury or damage of any kind arising from your access to or use of the service;
  • Any indirect, incidental, consequential, punitive or similar damages;
  • Interruptions, errors or failures in the availability of the service; or
  • Any content accessed through the service that is provided by third-party licensors.

NetEdux and its affiliates do not endorse or accept responsibility for the accuracy or reliability of any opinion, advice or statement provided through the service by third parties.

You hereby waive any and all claims against NetEdux and its subsidiaries, divisions, affiliates, agents, representatives and licensors arising out of your use of the service.

10. Internet and Technical Interruptions

If the service cannot operate as planned due to technical failures, system infections, fraud, unauthorised intervention, or any other causes beyond NetEdux's control, NetEdux reserves the right to suspend, modify or terminate the service.

NetEdux assumes no liability for:

  • Errors, omissions or delays in service transmission;
  • Telecommunications or network failures;
  • Device, software or browser incompatibility with the service platform; or
  • Unauthorised access to or alteration of subscriber data.

Any attempt to deliberately damage the service platform or undermine its legitimate operation is a violation of applicable criminal and civil law. NetEdux reserves the right to seek damages to the fullest extent permitted by law.

11. Violation of Terms

NetEdux reserves the right, without prior notice and at its sole discretion, to:

  • Suspend or terminate your subscription if these Terms and Conditions are breached;
  • Deactivate or delete your account in the event of fraudulent, abusive or illegal activity;
  • Remove any content it considers illegal or for which a valid take-down notice has been received; and
  • Take legal action against any person who tampers with or attempts to undermine the service.

12. Indemnity

By using this service, you agree to release, discharge and hold harmless NetEdux (Pty) Ltd and its affiliates, representatives, directors, officers and employees from any and all liability, loss, harm, damages, costs or expenses arising from:

  • Your participation in or use of the service;
  • Any actions taken by any person authorised to use your account;
  • Disclosure of access credentials to third parties; or
  • Any content you transmit or receive through the service.

13. Amendments and Service Discontinuation

NetEdux may amend, modify, suspend or discontinue the service or these Terms and Conditions at any time with reasonable notice to subscribers via SMS or digital notification.

Continued use of the service after notification constitutes acceptance of the updated terms.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms and Conditions shall be subject to the jurisdiction of the South African courts.

By subscribing to or continuing to use this service, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
